Missing one document can result not only in a refusal to collect, but also in an inspection and a financial penalty. Therefore, it is worth knowing how to carry out the entire process in accordance with the regulations - without unnecessary nerves and costs.<\/p>\n\n\n\n<p>In this article, we explain exactly what to look out for in terms of documents and entitlements, related to the management of waste paper.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:25px\"><strong>Waste paper management and recycling regulations in Poland<\/strong><\/h2>\n\n\n\n<p>Waste paper management obligations stem from several key pieces of legislation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/download.xsp\/WDU20130000021\/U\/D20130021Lj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Law of 14 December 2012 on waste<\/a><\/strong> - the basic act governing the handling of waste, including recording and reporting obligations,<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/download.xsp\/WDU20200000010\/O\/D20200010.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Regulation of the Minister of Climate and Environment of 2 January 2020 on the waste catalogue<\/a><\/strong> - includes the classification of waste, including waste paper (codes 15 01 01, 20 01 01),<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/download.xsp\/WDU20160001742\/O\/D20161742.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Regulation of the Minister of the Environment on the detailed requirements for waste transport<\/a><\/strong> - concerns, inter alia, the carrier's obligation to hold the relevant documents.<\/li>\n<\/ul>\n\n\n\n<p>On the basis of these regulations, entities donating waste paper are obliged to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>having an entry in the BDO Register,<\/li>\n\n\n\n<li>the preparation of Waste Transfer Cards (WTP) and Waste Inventory Cards (WERC),<\/li>\n\n\n\n<li>the submission of annual reports on the quantity and management of waste.<\/li>\n<\/ul>\n\n\n\n<p>Surrendering waste for management is only the beginning of the journey, at the end of which the waste becomes part of a new product or a source of energy. Key tips\" width=\"720\" height=\"405\" src=\"https:\/\/www.youtube.com\/embed\/as6egYm_EiA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n<\/div><\/div>\n\n<\/div><\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>How to recycle waste paper - the necessary documents<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">(a) Waste Transfer Note (KPO)<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Who should stage it:<\/strong> entity producing\/transferring waste paper.<\/li>\n\n\n\n<li><strong>How:<\/strong> only electronically via the BDO system.<\/li>\n\n\n\n<li><strong>What it must include:<\/strong>\n<ul class=\"wp-block-list\">\n<li>details of the sender and recipient,<\/li>\n\n\n\n<li>waste code (e.g. 15 01 01),<\/li>\n\n\n\n<li>the weight of the waste,<\/li>\n\n\n\n<li>date and place of handover,<\/li>\n\n\n\n<li>details of the carrier and means of transport,<\/li>\n\n\n\n<li>confirmation of receipt by the recipient.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Why it matters:<\/strong> The document is the basis for the records and proof of the legality of the waste transfer.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">b) <strong>Agreement with waste collector<\/strong> - <strong>recommended and most important<\/strong><\/h3>\n\n\n\n<p>The waste generator should manage its own waste under the legislation, although it can also contract this out to another entity. How? He must conclude an appropriate contract with him. But who can be party to this contract? A recycler, a waste collector or a waste broker. However, whoever is entrusted with the task of dealing with the waste, the requirements that such an entity will have to fulfil must be taken into account. This issue is described in Article 27 of the Waste Act referred to above. Paragraph 1 therein indicates:<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-text-align-left has-theme-palette-2-background-color has-background\" style=\"border-style:none;border-width:0px;font-size:14px\"><blockquote><p><br><br><strong>The waste producer or other waste holder may have the following carried out<br>waste management obligations only to entities that have:<br>(1) a waste collection permit or a waste treatment permit, or<br>(2) concession for underground storage of waste, integrated permit,<br>a decision approving the extraction waste management programme,<br>extraction waste facility authorisation<br>or entry in the register of regulated waste collection activities<br>municipal waste from property owners - on the basis of separate<br>regulations, or<br>(3) entry in the register within the scope referred to in Article 50(1)(5)<br>- unless such activities do not require a decision or registration.<\/strong><\/p><\/blockquote><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\">The agreement we are referring to can take the form of:<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a waste management contract, or<\/li>\n\n\n\n<li>waste transfer agreements for recovery\/recycling,<\/li>\n\n\n\n<li>It can also take the form of a framework agreement with batch-specific annexes.<\/li>\n<\/ul>\n\n\n\n<p><strong>IMPORTANT!<\/strong> <span style=\"text-decoration: underline;\">The contract with the recipient is a key documentary evidence<\/span> - especially when inspected by the Environmental Inspectorate - that the waste went to an authorised operator who:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>has a waste collection\/processing decision,<\/li>\n\n\n\n<li>is entered in the BDO,<\/li>\n\n\n\n<li>keeps records in accordance with the regulations.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">c) <strong>Contract with waste carrier<\/strong> - <strong>optional, but often used<\/strong><\/h3>\n\n\n\n<p>If <a href=\"http:\/\/www.odpadytransport.pl\" target=\"_blank\" rel=\"noreferrer noopener\">you outsource waste transport<\/a> (e.g. not to the consignee, but to a separate carrier), then it is worthwhile or even necessary:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>conclude a contract for <a href=\"https:\/\/ekologistyka24.pl\/en\/order-transport\/\" target=\"_blank\" rel=\"noreferrer noopener\">waste transport<\/a>,<\/li>\n\n\n\n<li>ensure that the haulier is registered in Section VII of the BDO register (transport of waste),<\/li>\n\n\n\n<li>ensure that the haulier's details entered in the NPO (vehicle registration number, haulier's BDO number, etc.) are correct. This is because sometimes companies forget to update their data, which can cause them many problems later on.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">d) Confirmation of BDO entry<\/h3>\n\n\n\n<p>It is impossible to issue a KPO without an entry in the BDO Register, as everything begins and ends with it.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>To whom it applies:<\/strong>\n<ul class=\"wp-block-list\">\n<li>transferor,<\/li>\n\n\n\n<li>carriers,<\/li>\n\n\n\n<li>recipients.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Scopes of activity:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Division IV: waste treatment and recycling operators,<\/li>\n\n\n\n<li>Section VII: waste transporters,<\/li>\n\n\n\n<li>Division XII: for waste producers<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Directions:<\/strong>\n<ul class=\"wp-block-list\">\n<li>check the validity of the entity's entry,<\/li>\n\n\n\n<li>ensure that the scope of its activities covers a specific waste code<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">(e) Additional documents<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Transport licence:<\/strong> required for companies carrying out road haulage.<\/li>\n\n\n\n<li><strong>Waste treatment permit:<\/strong> required at the recipient (recycler).<\/li>\n\n\n\n<li><strong>Partner verification:<\/strong> each participant should check the others to ensure that they are in BDO and have the necessary authorisations, as verbal assurances alone are not enough. Waste management must be transparent and easily verifiable.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Most common mistakes<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Incorrect waste code:<\/strong> Many traders mislabel the paper waste code. However, this leads to inadequate record-keeping and potential sanctions. <a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20200000010\" target=\"_blank\" rel=\"noreferrer noopener\">Waste catalogue<\/a> points to three possible options:<\/li>\n<\/ul>\n\n\n\n<p>15 01 01 Paper and cardboard packaging<br>19 12 01 Paper and cardboard<br>20 01 01 Paper and cardboard<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Failure to update entry in BDO:<\/strong> It is necessary to update the data in BDO after an expansion of activities, a change of location or new types of waste.<\/li>\n\n\n\n<li><strong>Lack of entitlement with the consignee or carrier:<\/strong> This is because it happens that waste is sent to entities that do not have the required permits.
