The amount of waste, produced in businesses and households, is increasing year on year. Some of it can cause a real threat to human health and life. What is more, waste has a negative impact on the environment. For this reason, it is worth ensuring that it is regularly removed and then disposed of. However, you must not do this yourself - the transport is carried out by specialised companies with the appropriate authorisations.

Legal regulations regarding waste transport

Currently, any company involved in the transportation of waste must have the relevant permit to carry out this activity. Waste handling is regulated:

  • fragments of the Waste Act (as amended) of December 14, 2012,
  • Regulation of the Minister of the Environment of October 7, 2016 on detailed requirements for waste transport

From January 24, 2018, with the launch of the Register of entities introducing products in packaging and managing waste (BDO), consent to transport waste is issued by the Marshal's Office. It is granted upon entry of the entrepreneur into the BDO register and assignment of a registration number. Performing services related to the transport of waste without obtaining the required permits will result in a fine depending on the waste being transported. In extreme cases, it can even reach tens of thousands of zlotys.

Who can obtain a waste transport permit?

The business of professional waste transport can be carried out either by a private entrepreneur or by any municipal organisational unit designated by the authorities. The service provider must show a document indicating the specific type of waste transported and should have the data of the client. These are contained on the KPO card, which is issued in electronic form. The driver should be able to display it on a mobile device, laptop or any other equipment with a screen that ensures the readability of the document. It is also possible to print it out and present it in this form.

It is necessary to ensure that the entire waste management procedure complies with environmental protection regulations and does not pose a threat to human life and health. The collected waste is sent to storage, disposal or recycling. Their specific recipient is indicated by the authority ordering waste transport. There are no contraindications to extending the business of waste transportation to include the service of material processing - recovery or disposal.

What vehicles can be used to transport waste?

The legislator has also regulated the requirements, concerning the vehicles used to transport waste. First and foremost, according to the Regulation of the Minister of the Environment of 7 October 2016, they must be appropriately labelled and waste should be properly secured. The regulations also talk about where and how waste should be stored - it should be reliably sorted and then placed in dedicated containers.

The documents regulating the process of transporting hazardous materials throughout Europe are ADR, i.e. the European agreement covering the transport of hazardous goods, and the Basel Convention, which describes the issues of cross-border movement and disposal of hazardous waste.

Poland has been complying with the regulations of the ADR Convention for many years - it joined the agreement in 1975, and ratified the Basel Convention in 1996. In order to adapt to current realities, the legislator regularly changes the regulations and updates the content of the document (every two years). Therefore, every company operating in our country and dealing with the transport of hazardous materials is obliged to comply with the regulations and safety rules contained in ADR, which require, among others: waste transport permits.

What are the penalties for illegal transport of hazardous waste?

If hazardous waste is transported, e.g. for recycling purposes, in a manner inconsistent with the provisions of national law or the ADR convention, a fine ranging from PLN 200 to PLN 10,000 may be incurred. This is due to their negative impact on the environment, which is why strict regulations have been introduced, including: special conditions of their transport. Due to the basic chemical composition of the pollutants, which contain many compounds dangerous to the environment and people, it is also necessary to adapt to the regulations regarding meeting the requirements specified in the Waste Disposal Regulation. If they are not met, financial penalties should be taken into account, regardless of whether the entity committing the offense is an enterprise, an institution, or an organizational unit without legal personality.
