Information first and foremost
The information procedure in accordance with Regulation (EC) No 1013/2006 is an indispensable part of shipping waste across borders. However, the most important document in this process is the "Accompanying Document" of Annex VII. It contains detailed information about the waste and the shipment plan. This document plays a key role, both for the regulatory authorities and for the companies responsible for the transport. Importantly, it is the responsibility of the generator or holder of the waste to issue it.
Let the importance of the Annex VII document be evidenced by the fact that its absence can cause a number of problems. Among the most important are certainly:
- financial penalties - depending on the country in which the inspection revealed a lack of documentation, a separate tariff of penalties will apply. Importantly, these are most often imposed on both the driver involved in the waste shipment and the company that employs him or her
- cargo seizure - a frequently used precautionary measure. The load is stored in a designated place until the deficiencies in the documents are corrected. The seizure may also be due to technical defects in the vehicle that exclude it from further travel. In this case, the carriage can only continue after a replacement vehicle has been dispatched. The costs of storing the waste for the duration of the investigation are charged to the transport company.
- Obligation to return the waste to the generator/possessor - if the deficiency in the documentation cannot be remedied, the driver may be obliged to return the waste to its place of loading. This will, of course, be at the expense of the transport company
