BDO service for companies

Not every company knows that it should be listed in the BDO register. Some have an account set up, but it does not cover actual activity or does not contain complete data. It also happens that part of the information circulation takes place outside the system. Such practices were only allowed in the first months of the system's operation, when it was not working fully as it should. Now, however, the rules are absolute, so no explanations will work - if the data is not in the register, the authority has the right to draw the consequences. That is why we talk about the risk directly.

The amounts quoted are only statutory ranges. This is because the final penalty is set by the WIOŚ, taking into account factors such as the type of violation, the scale of the action and the impact on the environment. The highest sanctions concern serious damage, but even 'smaller' breaches have consequences. Disregarding the BDO strikes not only legally, but also in terms of image: contractors may stop orders and tenders will be lost. Below we show where mistakes are easiest to make and how to assess the risks quickly.

When a company expands, the roles and processes at BDO change. Do you buy a car to haul waste on contract? Do you enlarge your warehouse because there are new fractions you want to generate? Do you open an additional location or start collecting waste rather than just generating it? Each of these decisions requires that the entry in BDO reflects reality: the correct departments and processes, waste codes, business locations, transport and authorised persons. Updating is not an add-on - it is a condition of legality.

If the entry in the register does not match the facts, the risk arises immediately. The contractor is obliged to check the company in the BDO and when something raises its doubts, it can and should stop collection. The WIOŚ sees the difference between what you do and what you have in your entry. The result can be simple: suspension of the extended service until the changes are published, plus an administrative decision and an appropriate penalty. Remember that a request made does not entitle you to act on the new scope until the entry is published. Therefore, plan for an update before you think about the first order. The Waste Transfer Sheet is created in the BDO register even before the transport starts, and the parties involved in the shipment approve it in the subsequent steps. This is where mistakes are easiest to make, as time pressure can be high. An error in the waste code can result from haste, misinterpretation of the result of a physico-chemical analysis or-although rarely-a deliberate underestimation of risk. The same happens with weight: someone enters an estimate instead of the result of the weight measurement and problems are bound to arise. The carrier and consignee data are loaded using the BDO numbers, so if there is an inconsistency, it is due to errors in the original entry of the entity. However, the details of the means of transport are entered manually, so a typo in the registration or substitution of a semi-trailer is a classic human error. This is why vigilance counts here.

And when the KPO is circulated with an error and an inspection stops the vehicle, it turns out that the documents are not consistent with, for example, the CMR. This is when the corrections and phone calls begin and the spectre of demurrage and late unloading arises. It is better to prevent this. It is important to check all data on the waste transfer note before the goods are loaded onto the trailer. It is also the responsibility of everyone involved in the transport to verify the data, as everyone is collectively responsible for errors.

The legislator has decreed that waste records must be made 'immediately', while leaving room for interpretation of this concept. One company will record waste as soon as the service that generated it has been completed. For another company, 'immediately' may mean 'once a week' as its summary. Another may interpret it yet differently. However, it all boils down to the fact that, in the final analysis, data should be collected systematically. All it takes, however, is a minor error.

Then the domino effect kicks in. A small gap in the records shifts subsequent entries, obliterates dates and distorts totals. The recipient queries, and you try to go back to records of events from weeks ago. The solution is simple, although it requires discipline: meticulous writing down of everything related to waste management (or you have to prepare for financial penalties). A report based on this data is submitted in mid-March each year, but the first quarter can be chaotic, so it is worth developing a plan to ensure that everything runs smoothly and the report is received by the authority.

It is best to spread everything out over the quarters and, at the end of each quarter, check the consistency of data from completed orders, KPOs and other documents that may be relevant. In this way you won't have to worry about errors in the report, because you won't be acting in haste, but only calculating based on verified data.
